The City of Biloxi, Mississippi will receive Sealed or Electronic Bids
until 10:00 a.m. on the 3rd day of June, 2020, for surplus real property,
pursuant to the provisions of Miss. Code Ann. §21-17-1(2)(a) (1972), as amended.

It is the City’s intent to sell approximately 0.174 acres of vacant and unimproved real property, located on the north side of Division Street, immediately east of the 1-110 exit ramp, and identified as Tax Parcel No. 11410E-04-013.000.

All Bids will be considered and judged based on the following criteria:

• Bidder’s plan for developing the property, including proposed use(s) (25%)
• Bidder’s timeline for developing the property (25%)
• Consistency with the City’s goals and objectives for development of the downtown area (25%)
• Purchase price (25%)

All Bids should address the above-stated criteria. Bidders are encouraged to include renderings and proposed site plans

At the City Council meeting conducted on April 28, 2020, the City found that the property was no longer needed for municipal purposes and is unlikely to be used in the future operations of the City. As a result of these findings, the City declared the property to surplus and authorized the sale thereof.

All parcels purchased shall be sold “as is, where is,” with Purchaser responsible for any and all legal costs, filing fees, and other costs, including costs to confirm title. If Bid is accepted, Purchaser shall enter into a formal Contract for Sale with the City, which is subject to approval by the Biloxi City Council. Purchaser must be prepared to deliver certified funds for payment in full within 10 days following approval of the Contract for Sale by the Biloxi City Council.

All Sealed Bids must be on file with the Municipal Clerk prior to the opening time as stated above. All bids must be sealed and clearly marked on the outside of the envelope as indicated: “Sale of Surplus Real Property- North Side of Division.” Sealed Bids not so marked are submitted at the risk of the prospective bidder and the City assumes no responsibility for the premature opening of same by any City Employee.

Bids sent through U.S. Mail are done so at the risk of the prospective bidder and should be addressed to the City of Biloxi, City Hall, P.O. Box 429, Biloxi, MS 39533. The City is not responsible for Bids that arrive in the mail after the designated opening time. Bids may be delivered in person to City Hall, Second Floor, 140 Lameuse Street, Biloxi, MS.

If City Hall is closed for any reason, including but not limited to: acts of God, strikes, lockouts, riots, acts of war, epidemics, governmental regulations superimposed after the fact, fire, earthquakes, floods, or other natural disasters (the “Force Majeure Events”), which closure prevents the opening of bids at the advertised date and time, all bids received shall be publicly opened and read aloud on the next business day that the agency shall be open and at the previously advertised time. The new date and lime of the bid opening, as determined in accordance with this paragraph, shall not be advertised, and all Bidders, upon submission of a bid, shall be deemed to have knowledge of and shall have agreed to the provisions of this paragraph. Bids shall be received by the City until the new date and time of the bid opening as set forth herein. The City shall not be held responsible for the receipt of any bids for which the delivery was attempted and failed due to the closure of City Hall as a result of a Force Majeure Event. Each Bidder shall be required to ensure the delivery and receipt of its bid by the City prior to the new date and time of the bid opening.

The City expressly reserves the right to accept or reject any or all bids or any part of any or all bids based on a highest and best bid determination. The City reserves the right to waive informalities.

Bids may be held by the City for a period not to exceed ninety (90) days from the date of submittal for the purpose of reviewing the bids prior to the Sale of this Surplus Property.
