Electronic or Sealed Bids for STORM DRAIN IMPROVEMENTS: DAVIDSON AND CALHOUN will be received by the City of Ocean Springs, at the office of the City Clerk, 1018 Porter Avenue, Ocean Springs, Mississippi until 2:00 P.M. (Central Time) on Monday, December 9th, 2024, and then will be publicly opened and read. Any bids received after the time and date specified will not be considered and will be returned unopened to the sender.

Contractors have the option of submitting their bids electronically through www.oceanspringsbids.com OR sealed in an envelope and delivered to the City Clerk of Ocean Springs, Mississippi, located at 1018 Porter Avenue, Ocean Springs, Mississippi; marked “SEALED BID TO BE OPENED AT 2:00 P.M. (Central Time), Monday, December 9th, 2024” for “STORM DRAIN IMPROVEMENTS: DAVIDSON AND CALHOUN on the exterior of the envelope for the following:

All bid envelopes shall contain the bidder’s name and mailing address on the face of the envelope. The bidder’s Certificate of Responsibility number or a statement that the bid enclosed is less than $50,000.00 shall appear on the outside or exterior of the envelope or other packaging of such bids. Bid envelopes or other packaging that do not meet the aforementioned labeling requirements shall not be opened or considered.

Scope of Services: The work shall consist of, but is not limited to, the contractor supplying the labor, equipment, superintendence, material, etc. for the construction / improvements to storm drain structures and roadway repairs throughout Davidson and Calhoun Channels. This work includes but is not limited to removal and replacement of existing drainage structures, installation of temporary erosion control measures, temporary traffic control, clearing and grubbing of vegetation throughout the channel(s), embankment added to washed-out areas of the channels, removal of pedestrian bridges, placement of rock rip rap, installation of sheet pile walls, and removal and replacement of roadways, driveways, and fences throughout Davidson and Calhoun channels. All work shall be completed within 120 working days from issuance of Notice to Proceed.

Activity performed under this project may contain in whole or in part grant funding from the Mississippi Department of Environmental Quality / Mississippi Municipality and County Wastewater Infrastructure Grant (MCWI), provided through funds awarded to the State of Mississippi under the American Rescue Plan Act (ARPA). Any contract resulting from this solicitation will be subject to the terms and conditions of said funding award and all applicable terms and conditions in 2 C. F. R. Part 200 (including Appendix II to Part 200), and all other OMB circulars, executive orders or other federal laws or regulations, as applicable. The Mississippi Department of Environmental Quality, the United States, or any of its departments, agencies or employees is not and will not be a party to this solicitation or any resulting contract.

Fenstermaker & Associates L.L.C., 2112 Bienville Boulevard, Suite E, Ocean Springs, Mississippi, 39564 between the hours of 8:00 A.M. and 5:00 P.M. Monday through Friday or online at www.oceanspringsbids.com.

Bidding Documents are being made available via paper copy or pdf for a charge of $150.00 (hard copy) or $75.00 (CD). When submitting an electronic bid, the bid must be in “pdf” format and shall contain the same information and forms as required for paper bids. When submitting a bid electronically, the authorized signature shall be an electronic signature or handwritten in blue ink signature. In the event that an electronically submitted bid has a corrupt attachment, the bid will be considered null and void. When a bid is submitted electronically, the requirement for including a Certificate of Responsibility number or a statement that the bid enclosed does not exceed $50,000.00 on the exterior of the envelope shall be deemed in compliance by including the same information as an attachment with the electronic bid submittal.

Each bid shall be accompanied by a certified check, cashier’s check, or bid bond payable to the City of Ocean Springs, the amount of which shall be five percent (5%) of the base bid plus additive alternates.

No bidder may withdraw his bid for at least forty-five (45) days after the time scheduled for the opening of bids. Each bid shall be submitted only on the bid form provided with the specifications. The successful contractor will be required to execute performance and labor and material payment bonds in the full amount of the contract as more fully defined in the bid documents.

In order to perform public work, the successful bidder shall, as applicable, hold or obtain such Contractor’s and business license as required by Mississippi state statutes including certification of responsibility required by Section 31-3-21 to have a current Certificate of Responsibility issued by the Mississippi State Board of Public Contractors prior to bidding on the project.

Before a Contract will be awarded for the work contemplated herein, the Owner will conduct investigation as is necessary to determine the performance record and ability of the apparent lowest, responsible, responsive, qualified bidder to perform the size and type of work specified under this Contract. Upon request, the bidder shall submit such information as deemed necessary by the Owner to evaluate the bidder’s qualifications.

The City reserves the right to reject all bids or any bid not conforming to the intent and purpose of the Contract Documents and to postpone the award of the Contract for a period of time which, however, shall not exceed 90 days from the bid opening date.
